These Terms & Conditions (“Terms”) govern your use of sunshineorthopedics.com and any text messages, forms, or online tools provided by Sunshine Orthopedic Clinic, PLLC (“Sunshine Orthopedics,” “we,” “our”). By using the website or receiving communications from us, you agree to these Terms. Care you receive as a patient of the practice is governed separately by the paperwork you sign at your first visit and by our HIPAA Notice of Privacy Practices.

1. Website use

You may use this website to learn about our services, contact us, and access links to our patient portal and appointment scheduler. You agree not to interfere with the site, attempt to bypass any access control, or use the site in a way that violates any law.

2. No medical advice

The content on this website, and any general information we send by text or email, is provided for informational purposes only and is not medical advice, diagnosis, or treatment. Reading this site or receiving a text from us does not create a physician–patient relationship. Always call our office or a qualified clinician about your specific medical situation, and call 911 or go to the nearest emergency department for any emergency.

3. Communications — email and forms

Forms on this site (such as the “Request Portal Access” form on our Patient Portal page) are delivered to our office inbox by your own email client. Please do not send sensitive medical information through website forms or unencrypted email; use the Patient Portal on onpatient.com for anything you would want protected.

4. Text messages (SMS) — terms of use

By providing your mobile number to Sunshine Orthopedics and opting in as described in our Privacy Notice, you agree to the following SMS terms.

4.1 What we may send

  • Appointment reminders and confirmations for scheduled visits
  • Practice notifications — office closures, schedule changes, results-ready alerts, and requests to call the office
  • Recall and care-continuity messages — periodic reminders that you are due for a follow-up, imaging review, or annual visit, and occasional educational or practice updates from Sunshine Orthopedics

4.2 Frequency, cost, and carrier

Message frequency varies by your care needs; a typical patient receives fewer than 10 messages per month. Message and data rates may apply depending on your mobile carrier and plan. Carriers are not liable for delayed or undelivered messages.

4.3 How you opt in

You opt in to text messages by providing your mobile number and giving express consent through one of the following:

  • Checking the SMS-consent box on our patient intake or contact forms
  • Verbally confirming with our staff on the phone or in person, which we record in your chart
  • Replying YES, START, or a similar affirmative to an initial opt-in text we send you

Consent to receive text messages is not a condition of receiving medical care.

4.4 How you opt out and get help

You can stop text messages at any time by replying STOP to any message we send. We will send a single confirmation that you have been unsubscribed. 4.5 Your mobile information

Your mobile number and any information you share by text with Sunshine Orthopedics are used solely to communicate with you about your care and our practice. We do not sell, rent, or share your mobile number, text-message content, or SMS opt-in status with third parties or affiliates for their marketing or promotional purposes. Data is shared only with our messaging vendor (Nimblr / Holly AI) and our EHR (DrChrono) as needed to deliver the service, both of which are bound by HIPAA business-associate agreements. Please do not include sensitive medical details you would not want in an unencrypted text.

5. Third-party services

Some features are provided by third parties: the online scheduling widget is provided by DrChrono; the Patient Portal is OnPatient (also DrChrono); and text messaging is provided by Nimblr / Holly AI. When you use those features, the third party’s terms and privacy policies also apply.

6. Intellectual property

The Sunshine Orthopedics name, logo, site design, and content are the property of Sunshine Orthopedic Clinic, PLLC. You may share links to public pages, but you may not copy, redistribute, or use our branding without written permission.

7. Disclaimer of warranties

The website is provided “as is” without warranties of any kind, express or implied. We work to keep the site accurate and available but do not guarantee it will be error-free, uninterrupted, or free of viruses or other harmful components.

8. Limitation of liability

To the maximum extent permitted by law, Sunshine Orthopedic Clinic, PLLC and its owners, employees, and vendors are not liable for indirect, incidental, or consequential damages arising from your use of the website or website-based communications. Nothing in these Terms limits any right you have under Florida law or under the professional relationship you have with your treating physician.

9. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of the website or SMS communications shall be resolved in the state or federal courts located in Broward County, Florida.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by a revised effective date at the top of this page. Continued use of the website or SMS service after changes take effect constitutes acceptance of the updated Terms.
